Your rights under RERA
Under Section 18 of the RERA Act, 2016 a homebuyer whose builder fails to hand over possession by the agreed date may either:
- Withdraw and claim refund with interest (SBI MCLR + 2%), or
- Continue and claim monthly interest for the delay period
Filing a MahaRERA complaint
- Form B via maharera.mahaonline.gov.in
- ₹5,000 fee for individual buyers
- Adjudicating Officer decides compensation; Authority decides refund
Appeal
An appeal lies before the Maharashtra Real Estate Appellate Tribunal (MahaREAT), Mumbai within 60 days, subject to 30% pre-deposit for promoters.
